Innotech Equipment Inc. warrants to the Customer only that the Hire Goods, when delivered, are in good operating condition. If equipment or product is not received in good operating condition due to no fault of the Customer, Innotech Equipment Inc. shall, at its sole option, either repair or supply replacement equipment, subject to availability.
Defects, discrepancies, or objections to the equipment must be reported to Innotech Equipment Inc. within 24 hours after the Customer receives the equipment.
The Customer shall pay the rental charges for any services, monies for any products, and/or any sums payable under the contract to the Supplier at the time and in the manner agreed, as specified in the contract. If the Customer fails to make any payment in full on the due date, the Supplier may charge the Customer interest on the amount unpaid at the rate of 2.0% per month.
Risk in the Hire Goods and any products will pass immediately to the Customer when they leave the physical possession or control of the Supplier. Ownership of the Hire Goods remains at all times with the Supplier.
It is the responsibility of the Customer to collect the Hire Goods from the Supplier and return them to the Supplier at the end of the Hire Period. If the Supplier agrees to deliver or collect the Hire Goods to and/or from the Customer, it will do so at its standard delivery cost.
The Customer shall not remove any labels from and/or interfere with the Hire Goods, their working mechanisms, or any other parts of them. The Customer shall take reasonable care of the Hire Goods and only use them for their proper purpose in a safe and correct manner.
The Customer shall notify the Supplier immediately after any breakdown, loss, and/or damage to the Hire Goods and must not continue to use the Hire Goods if they have been damaged. The Customer shall notify the Supplier of any change of address and, upon the Supplier’s request, provide details of the location of the Hire Goods.
The Hire Goods must be returned by the Customer in good working order and condition and in a clean and satisfactory state.
The Customer shall be responsible for all expenses, loss (including loss of rental income), and/or damage suffered by the Supplier arising from any breakdown of the Hire Goods due to the Customer’s negligence, misdirection, and/or misuse of the Hire Goods. The Customer must not repair or attempt to repair the Hire Goods unless authorized to do so in writing by the Supplier.
If the Hire Goods are returned in a damaged, unclean, and/or defective state, except where due to fair wear and tear and/or an inherent fault in the Hire Goods, the Customer shall be liable to pay the Supplier for the cost of any repair and/or cleaning required to return the Hire Goods to a condition fit for re-hire. The Customer will pay the Supplier the replacement cost of any Hire Goods that are lost, stolen, and/or damaged beyond economic repair during the Hire Period.
Each hire of an item of Hire Goods shall form a distinct contract, separate from any other contract relating to other Hire Goods.
The Customer shall be liable for the acts and/or omissions of its employees, agents, servants, and/or subcontractors as though they were its own acts and/or omissions under this contract.
Indemnity: Innotech Equipment Inc. will not be liable for any injury (including death or dismemberment) occurring as a result of the misuse of the Hire Goods.
The Customer agrees to provide a valid credit or debit card and a security deposit. The card will be placed in the system and used by the Company to settle any extensions, late returns, or damages to the rental unit. The Company reserves the right to charge the Customer’s card an amount equal to the estimate of the cost of repair for any damage and any excess charges. Any such charges will be refunded as applicable.
Please note: Weekend rentals cannot exceed 16 hours of usage as recorded by the hour meter. Any usage over 16 hours will incur a fee of $62.50 (VAT inclusive) per additional hour.
